This Flamines Website and iMob Forum Terms and Conditions of Use (the "Agreement") provides important information about your use of Flamines site (the "Site"). You should read it, understand it, and consider printing a copy for reference as you use the Site.

IMPORTANT: IF YOU CHOOSE TO ACCEPT THIS AGREEMENT, YOU MUST ACCEPT IT AS PRESENTED TO YOU, WITHOUT CHANGES. FLAMINES WILL NOT ACCEPT ANY ADDITIONS OR DELETIONS. Flamines ("FMS") may at any time, in its sole discretion, change, add, or remove any part of this Agreement or any features provided at the Site and update them on this page (http://www.flamines.org/terms.php).
You are bound by any such revisions and should therefore periodically visit this page to review the current Agreement.

Flamines will make good faith efforts to investigate allegations that Submissions violate this Agreement but (a) makes no warranty to you that it will edit, remove, or continue to permit the display of any specific Submission, whether or not subject to such allegations, and (b) will have no liability whatsoever for editing, removing, or continuing to permit the display of any Submission whatsoever. In addition to these terms, any Submission that questions Flamines policies and procedures or includes speculation on Flamines decisions may be removed.

II.RESTRICTION ON USE OF LOGOS, NAMES AND MATERIALS

Flamines's name and logos and all related product and service names, design marks and slogans are the trademarks or service marks of Flamines and Mac Developer Center or (MDC).

You are not authorized to use the letters "Flamines" or "FMS" or any current logo or former/old logo or any Flamines name or mark in any advertising, publicity or in any other commercial manner without the prior written consent of Flamines and Mac Developer Center.

You are not authorized to use the name "Mac Developer Center" or "MDC" or the current logo or former/old logo or any MDC name or mark in any advertising, publicity or in any other commercial manner without the prior written consent of Flamines and Mac Developer Center.

Any unauthorized modification, tampering or change of any information, or any interference with the availability of or access to this site is strictly prohibited.

This site contains material that is protected by international copyright and trademark laws. No material (including but not limited to the text, images, audio and/or video) and no software (including but not limited to any images or files incorporated in or generated by the software or data accompanying such software (individually and collectively the "materials") may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way or decompiled, reverse-engineered or disassembled, unless otherwise specified on the website with respect to particular materials.

The appearance of any User's address, e-mail address, fax number, or telephone number on this website does not constitute permission for you to contact that member for commercial purposes or to send that member facsimile advertisements or commercial electronic mail messages.

For your protection, Flamines would like to remind you that a U.S. federal law known as the "CAN-SPAM Act" places restrictions on how Internet users may send e-mail messages where the primary purpose of the message is commercial advertisement or promoting a commercial product or service. Please refer to the CAN-SPAM Act for further definition of "commercial messages".

If you plan to send a message to any address you obtain from the iMob Members Directory or elsewhere on Flamines website that might be considered primarily to be a commercial advertisement or to promote a commercial product or service, keep in mind that, a) you are prohibited from using e-mail addresses obtained from this website for solicitation and b) it is your responsibility to make sure you comply with the CAN-SPAM Act.

All links to other sites found on Flamines website are publicly available on the World Wide Web and are provided solely for the convenience of Users. Unless expressly stated otherwise, links on our website are not sponsored by, affiliated with, or the responsibility of Flamines, and the owners of such links are not affiliated with Flamines and do not sponsor or endorse Flamines website. Flamines has neither tested nor verified the content, accuracy, or opinions expressed on any links on Flamines website and disclaim any warranty or liability for damages associated therewith, including, without limitation, computer viruses or any other damages to your computer as a result of your using such links to third-party sites.

V. E-COMMUNICATIONS AND "UNDELIVERABLE" E-MAIL

As discussed above, the federal "CAN-SPAM Act" places restrictions on how Internet users may send e-mail messages where the primary purpose of the message is commercial advertisement or promoting a commercial product or service. Please refer to the CAN-SPAM Act for further definition of "commercial messages."

If Flamines is notified that your e-mail address is "undeliverable", e-communications to you from Flamines may be stopped. This includes, for registered Users, the Flamines iMob Forum.

We have listed possible reasons as to why e-mail messages from Flamines may not be accepted by your e-mail system and include SPAM-blocking measures or e-mail server issues used by (a) your organization's network, (b) your Internet Service Provider (ISP) or (c) your personal mail preferences. These reasons include:

1. Your e-mail server was off-line/down; your mailbox was full or your e-mail address invalid;
2. Your ISP or mailbox filter filed the message into a junk, spam or trash folder;
3. The network or ISP found a “black-listed” domain name or Internet Protocol (IP) address. This "blocking" may be for a Flamines domain or the domain of another member on the e-mail forum;
4. SPAM and/or virus scanning software found a "suspicious" keyword or a message as possibly harmful.

Here are some suggested steps you can take:

1. Some systems have a "white list" or "trusted list". Please put Flamines domains on these lists so that Flamines e-mails can reach you. Also, adding Flamines domains to your address book may assist this process on some e-mail systems.
2. Please be sure that Flamines has your current e-mail address. Update it at MY SETTINGS on the Flamines website and iMob forum and activate the "Subscribe for emails, special promotions or newsletters" radio-button in Preferences Tab.

VI. FLAMINES IMOB FORUM

Registration to the Forum is free! To use the Flamines iMob Forum, each User must provide his First and Last Names, e.g : John Smith, along with the password combination, which will constitute his iMob ID and a PERSONAL PICTURE. We do insist that you abide by the rules and policies detailed below.

Flamines, according to Flamines Privacy Policy, prevents your personal information, including your real names, picture and e-mail from being viewed by non-registered users. This information, along with the posts in individual topics will only be visible to registered members of the iMob. Registration of every new member is carefully evaluated by the Administrator, so YOUR PERSONAL INFORMATION IS COMPLETELY SAFE.

Participants in the iMob Forum are required to provide complete and accurate information when they register, including their real names, personal picture and verifiable e-mail address. If there is a substantive change in registration information, you agree to update your information online. Upon registering for the iMob Forum, you may not transfer your account to others. You may, however, demonstrate the iMob Forums to others, who may then register themselves.

The Flamines iMob Forum is to be used for non-commercial purposes only. Engaging in any improper use of this website is strictly prohibited. In addition, whereas healthy interaction, discussion and critique of ideas are encouraged, it is unacceptable to critique persons offering the ideas.

It is the responsibility of the Users to keep up to date virus protection software on their PC or Mac and scan all documents for viruses prior to posting documents to or downloading documents from the Flamines website. Flamines cannot be held accountable for any documents that contain viruses.

1. iMob ID AND SIGNATURE

a. ID
To use the Flamines iMob Forum, each User must provide his First and Last Names, e.g : John Smith, along with the password combination, which will constitute his iMob ID and a PERSONAL PICTURE. To learn how to get your iMob ID, look here . You must be at least 13 years old to be able to post to the Flamines iMob Forum. Please review the Flamines Privacy Policy, which describes how Flamines collects, uses and protects your personal information. It is your responsibility to provide and maintain a valid email address in your profile for use of Flamines website. Flamines cannot and will not be responsible for any problems or liability that may arise if you do not provide accurate, truthful, and complete information.

You will receive an iMob ID upon completing the Flamines iMob Forum registration process.

Each User is allowed one login account. Registering with multiple accounts is not allowed.

You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account.

You agree: (a) not to allow any other person or entity to use your identification for posting or viewing comments; (b) to immediately notify Flamines of any unauthorized use of your password or account or any other breach of security, and (c) to ensure that you exit from your account at the end of each session.

b. SIGNATURE
All signatures should not exceed a 255 character limit, and you can't have any images.

2. USER CONDUCT

You agree not to use Flamines iMob Forum to:

a. Upload, post, email, transmit or otherwise make available any Submission that is unlawful, harmful, threatening, indecent, intimidating, discriminatory, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, pornographic, sexually explicit, or racially, ethnically, culturaly or otherwise objectionable or, in general, do not represent the professional collegial atmosphere intended for the iMob Forum;

b. Continue to disrupt the normal flow of dialogue, or post comments that are not related to the topic being discussed after receiving a warning;

c. Use inappropriate user names. Inappropriate or offensive user names or aliases will be removed.

d. Harm minors in any way;

e. Impersonate any person or entity, including, but not limited to, a Flamines member, forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity;

f. Forge headers or otherwise manipulate identifiers in order to disguise the origin of any Submissions transmitted through the iMob Forum;

g. Upload, post, email, transmit or otherwise make available any Submissions that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure Agreement);

h. Upload, post, email, transmit or otherwise make available any Submissions that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;

i. Upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation, except in those areas that are designated for such purpose;

j. Use the iMob Forum to post information relating to or conduct any private business or commercial activity without the prior written consent of Flamines (commercial activities include, but are not limited to, posting or transmitting information or other material that could reasonably be construed by Flamines as constituting promotional announcements, product-related press releases, marketing, advertising, solicitation of business, sale or attempted sale of products or services);

k. Upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

l. Forward any message or material posted in the Flamines iMob Forum to any third parties, who are not subscribers to the iMob Forum, without the prior written permission of the individual who posted such message or material.

m. Use the iMob Forum to communicate with potential participants in formal research of any kind, or to conduct market research, surveys, or academic studies without prior approval of Flamines. However, informal questions posted to the forum are encouraged, provided that such questions do not otherwise violate these terms and conditions.

n. Cause a screen to "scroll" faster than other Users of the iMob Forum are able to type, or otherwise act in a manner that negatively affects other Users' ability to engage in real time exchanges;

o. Interfere with or disrupt the iMob Forum or servers or networks connected to the iMob Forum, or disobey any requirements, procedures, policies or regulations of networks connected to the iMob Forum;

p. Intentionally or unintentionally violate any applicable local, state, national or international law;

q. "Stalk" or otherwise harass another; or

r. Harvest or otherwise collect and store personal data about other Users, including email addresses, without their identification for posting or viewing comments consent;

s. Use the iMob Forum to promote advocacy efforts that are not sanctioned by Flamines or to gather information or data to support advocacy efforts, without first obtaining the prior written authorization of Flamines;

3. SUBMISSIONS

You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials ("Submissions"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Submissions originated. This means that you, and not Flamines, are entirely responsible for all Submissions that you upload, post, email, transmit or otherwise make available via Flamines iMob Forum. Flamines does not control the Submissions posted via iMob Forum and, as such, does not guarantee the accuracy, integrity or quality of such Submissions.

The personal information you submit to Flamines is governed by the Flamines Privacy Policy. To the extent there is an inconsistency between this Agreement and the Privacy Policy, this Agreement shall govern.

a. All postings to the Flamines iMob Forum must contain the author's iMob ID and personal picture and no anonymous postings will be permitted. If you do not wish your e-mail address to be displayed publicly, then you should not send any message to the forum.

b. Search or browse for existing answers before you ask a question. Someone else may have asked your question — it may save you some time.

c. Stay on topic. iMob Forum is here to help people use and practice homeopathy more effectively.

d. State your question clearly. Include as much information as you can about your issue.

e. Be polite. Everyone should feel comfortable reading Submissions and participating in forums. Flamines will not tolerate flames or other inappropriate statements, material, or links. Most often, a "flame" is simply a statement that is taunting and thus arbitrarily inflammatory. However, this also includes those mentioned in USER CONDUCT.

f. Material submitted must be your own work or work to which you have a license. You warrant and represent that you own or otherwise control all of the rights to the information contained in your Submission.

g. You acknowledge that Flamines does not pre-screen Submissions, but that Flamines and its designees shall have the right (but not the obligation) to remove any Submissions that violates this Agreement or is otherwise objectionable.

h. You acknowledge and agree that Flamines may preserve Submissions and may also disclose Submissions if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce this Terms and Conditions of Use; or (c) respond to claims that any Submissions violates the rights of third parties.

i. If you make any submission to Flamines iMob Forum or if you submit any business information, idea, concept or invention to Flamines by email, you agree such submission is non-confidential for all purposes and you automatically grant—or warrant that the owner of such Submissions or intellectual property has expressly granted— Flamines a royalty-free, perpetual, irrevocable, world-wide nonexclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform, and display the communication or content in any media or medium, or any form, format, or Forum now known or hereafter developed. Flamines may sublicense its rights through multiple tiers of sublicenses. If you wish to keep any business information, ideas, concepts or inventions private or proprietary, do not submit them to the Flamines iMob Forum or to Flamines by email. We try to answer every email in a timely manner, but are not always able to do so.

j. If you receive compensation or personal benefit from a purchase or service you advocate, or from an affiliate link, you must note this in your Submission by stating, "I may receive some form of compensation, financial or otherwise, from my recommendation or link" ;

4. LINKS

The Flamines iMob Forum may provide, or third parties may provide, links to other World Wide Web websites or resources. Because Flamines has no control over such websites and resources, you acknowledge and agree that Flamines is not responsible for the availability of such external websites or resources, and does not endorse and is not responsible or liable for any Submissions, advertising, products, or other materials on or available from such websites or resources. You further acknowledge and agree that Flamines shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Submissions or goods available on or through any such website or resource.

5. TERMINATION

If you post or send offensive or inappropriate content anywhere on or to the iMob Forum or otherwise engage in any disruptive behavior which Flamines considers to be serious and/or repeated, Flamines reserves the right, in its sole discretion, to terminate a User's permission to use Flamines iMob Forum for reasons including, but not limited to, the policies and guidelines described and may use all available information about you to stop any further infringements. If you are using a paid subscription service, and we terminate your User's permission because you have breached this Agreement, you will not be entitled to any refund of unused subscription fees. Even after your User's permission is terminated, certain sections of this Agreement will remain in effect. If your User's permission is terminated, you may contact Flamines website administrator for reinstatement by sending an email to service@flamines.org. Flamines website administrator, in his or her sole discretion, will consider such a request for reinstatement and will respond within a reasonable period of time to such request. Reinstatement is at your own discretion by registering again to use Flamines website.

VII. NOTICE AND TAKE DOWN PROCEDURES

If you believe any materials accessible on or from Flamines website infringe your copyright, you may request removal of those materials (or access thereto) from this website by contacting the Flamines copyright agent (identified below) and providing the following information:

a. Identification of the copyrighted work that you believe to be infringed. Please describe the work, and where possible include a copy or the location (e.g., URL) of an authorized version of the work.

b. Identification of the material that you believe to be infringing and its location. Please describe the material, and provide us with its URL or any other pertinent information that will allow us to locate the material.

c. Your name, address, telephone number and (if available) e-mail address.

d. A statement that you have a good faith belief that the complained of use of the materials is not authorized by the copyright owner, its agent, or the law.

e. A statement that the information that you have supplied is accurate, and indicating that "under penalty of perjury," you are the copyright owner or are authorized to act on the copyright owner's behalf.

f. A signature or the electronic equivalent from the copyright holder or authorized representative.

In an effort to protect the rights of copyright owners, Flamines maintains a policy for the termination, in appropriate circumstances, of User's permissions for Flamines website and iMob Forum who are repeat infringers.

VIII. INDEMNITY

You agree to defend, indemnify and hold Flamines, and its subsidiaries, affiliates, officers, directors, employees, licensors, suppliers and agents harmless from any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, made by any third party due to or arising out of Submissions you submit, post, transmit or make available through Flamines iMob Forum or otherwise arising from your use of Flamines website.

IX. DISCLAIMER OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

YOUR USE OF THE FLAMINES WEBSITE IS AT YOUR SOLE RISK. FLAMINES WEBSITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. FLAMINES EXPRESSLY DISCLAIMS TO THE FULLEST EXTENT PERMITTED BY LAW, ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

When using Flamines website, information will be transmitted over a medium that may be beyond the control and jurisdiction of Flamines and its suppliers. Accordingly, Flamines assumes no liability for or relating to the delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of Flamines webite.
Flamines makes no representations or warranties about the accuracy, reliability, completeness, currentness, or timeliness of the Submissions, software, text, graphics, links, or communications provided on or through the use of Flamines webite.
Flamines makes no representations or warranties about the satisfaction of any government regulations requiring disclosure of information on prescription drug products or the approval or compliance of any software tools with regard to the Submissions contained on Flamines iMob Forum.

FLAMINES MAKES NO REPRESENTATIONS OF WARRANTIES THAT THE FLAMINES iMOB FORUM WILL (i) MEET YOUR REQUIREMENTS, (ii) WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE WILL BE ACCURATE OR RELIABLE, (iv) THAT THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION OBTAINED BY YOU THROUGH THE ONLINE COMMUNITY WILL MEET YOUR EXPECTATIONS, AND (V) THAT ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF FLAMINES iMOB FORUM IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT FLAMINES, its licensors, its suppliers, or any third parties mentioned on the Flamines website SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF FLAMINES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE FLAMINES iMOB FORUM; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE FLAMINES iMOB FORUM; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE FLAMINES iMOB FORUM; OR (v) ANY OTHER MATTER RELATING TO FLAMINES WEBSITE OR iMOB FORUM.

Flamines, its licensors, its suppliers, or any third parties mentioned on Flamines website are not liable for any personal injury, including death, caused by your use or misuse of the Site, Submissions, or Flamines iMob Forum.

XI. SEVERABILITY

If any provision of these Terms and Conditions of Use is determined to be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions of Use and shall not affect the validity and enforceability of any remaining provisions.

XII. REPRINT/REPRODUCTION REQUESTS

Flamines will consider requests for usage of their respective materials. Please submit requests for reprinting and reproduction of materials directly to service@flamines.org

XIII. REPRODUCTION AND USE OF FLAMINES SURVEY DATA

Reproduction or public display of Flamines survey data is expressly forbidden. Flamines will grant permission to qualifying media and other designated outlets for "limited" use of data points, generally 25 data points or less per edition, per publication or approved media outlet. This permission is granted through Flamines Media Relations Manager at press@flamines.org.

XIV. OBTAINING FMS's CONSENT

To request the consent of Flamines for any of the actions for which such consent is required under these Agreement, please send an e-mail to service@flamines.org

Flamines reserves the right to refuse any such requests in its sole discretion.
